Welcome to PrimeFlow (“we,” “us,” “our”). We operate this website and all related features, content, tools and services (collectively the “Services”) to offer you a curated shopping experience. PrimeFlow is powered by Shopify, which enables us to provide these Services.
These Terms of Service (“Terms”), together with any policies referenced below, govern your use of the Services. By visiting or using the Services you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please refrain from using the Services.
1 – ACCESS & ACCOUNT
You confirm that you are at least the age of majority in your country of residence (18 in most EU states) and that any minors using the Services do so with your consent.
To buy from us you must provide accurate, current and complete information. You alone are responsible for safeguarding your account credentials and for all activities that occur under your account.
2 – OUR PRODUCTS
We strive to display our products as accurately as possible, yet colours and appearance can vary with screen settings. Descriptions, prices and availability may change at any time without notice. We reserve the right to limit sales of any product to any person or region.
3 – ORDERS
Placing an order constitutes an offer to purchase. We may accept or decline any order at our discretion and only do so after payment is processed. Before submitting, please review your basket carefully; cancellations might not be possible once an order is accepted.
Returns and exchanges follow our Refund & Returns Policy. All purchases are for personal use only and not for resale or export.
4 – PRICES & BILLING
All prices are shown in euros (€) and include German VAT unless otherwise noted. Shipping charges (if any) are added at checkout according to our Shipping Policy.
Promotions may carry additional terms; if a promotion conflicts with these Terms, the promotion rules apply.
You warrant that the payment details you provide are correct and that you are authorised to use the chosen payment method.
5 – SHIPPING & DELIVERY
Dispatch times, costs and estimated transit times are outlined in our Shipping Policy. Title and risk of loss pass to you when the parcel is handed to the carrier. We are not liable for carrier delays or events beyond our control.
6 – INTELLECTUAL PROPERTY
All content on the Services (text, graphics, trademarks, designs, etc.) belongs to PrimeFlow or its licensors and is protected by applicable intellectual-property laws. Personal, non-commercial use is permitted; any other use requires prior written consent.
7 – OPTIONAL TOOLS
Any third-party tools provided via the Services are offered “as is.” Use them at your own risk and review the third party’s terms before use.
8 – THIRD-PARTY LINKS
Links to external sites are provided for convenience. We do not endorse and are not responsible for third-party content or transactions. Review third-party policies before engaging.
9 – RELATIONSHIP WITH SHOPIFY
PrimeFlow is “powered by Shopify.” Purchases are made directly with PrimeFlow. Shopify bears no responsibility for any transaction between you and PrimeFlow.
10 – PRIVACY
Personal data is processed according to our Privacy Policy and, where applicable, Shopify’s Privacy Policy.
11 – FEEDBACK
By submitting ideas or reviews (“Feedback”) you grant us a perpetual, worldwide, royalty-free licence to use that Feedback for any purpose, without obligation to you.
12 – ERRORS & OMISSIONS
Information on the Services may contain errors or omissions. We reserve the right to correct or update information—or cancel orders affected by errors—at any time.
13 – PROHIBITED USES
You agree not to misuse the Services, including—but not limited to—violating laws, infringing IP rights, transmitting malicious code, or engaging in fraudulent activity. We may suspend or terminate accounts that breach these Terms.
14 – TERMINATION
We may terminate or suspend your access to the Services at any time. Sections that by their nature should survive termination (e.g., Intellectual Property, Limitation of Liability) will continue to apply.
15 – DISCLAIMER OF WARRANTIES
Except as expressly stated by PrimeFlow, the Services and all products are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability and fitness for a particular purpose.
16 – LIMITATION OF LIABILITY
To the fullest extent permitted by law, PrimeFlow and its affiliates shall not be liable for indirect, incidental, special or consequential damages arising from your use of the Services or products.
17 – INDEMNIFICATION
You agree to indemnify and hold harmless PrimeFlow, Shopify and their respective affiliates against any claims arising from your breach of these Terms or your improper use of the Services.
18 – SEVERABILITY
If any provision of these Terms is held unlawful or unenforceable, the remaining provisions remain in effect.
19 – WAIVER & ENTIRE AGREEMENT
Our failure to enforce any right is not a waiver. These Terms, together with linked policies, constitute the entire agreement between you and PrimeFlow.
20 – ASSIGNMENT
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms without notice.
21 – GOVERNING LAW
These Terms are governed by the laws of the Federal Republic of Germany. Exclusive place of jurisdiction is the competent court in the city where PrimeFlow is registered.
22 – HEADINGS
Headings are for convenience only and do not affect interpretation.
23 – CHANGES TO THE TERMS
We may modify these Terms at any time. Material changes will be announced on the website and are effective on the stated date. Continued use after changes constitutes acceptance.
